Kenyan Opinion Highlights–five columns of note (updated)

These are four  five recent columns from the Kenyan papers on different aspects of the current malaise in public affairs.  Each makes a general point which I think is of undoubtedly valid, but adds some perspective, analogy or point of fact that struck me as unique and particularly worthy of your attention if you missed it at the time:

Jay Naidoo of The Daily Maverick writes from “the Mukuru Kwa Reuben slum, one of the largest in Nairobi” with an unknown population size: “I have a right to a toilet–it’s human dignity”.

An update on the preparation for Kenya’s citizen digital “crowdsourced” monitoring/mapping effort, using the Ushahidi software: “Uchagazi Community Next Steps”.

H/t to the UN Dispatch blog for noting another official pre-election delegation in Nairobi: “Kenya: UN official stresses need for peaceful and transparent elections”:

“Kenya’s elections will be watched closely around the world,” Under-Secretary-General for Political Affairs Jeffrey Feltman said during a visit to Nairobi, the capital.

“Let me take this opportunity to appeal to all Kenyans to exercise their democratic right and participate actively – but peacefully – in the elections,” he said. “Let me also underscore the responsibility shared by leaders at all levels to abide by legal mechanisms and to send a clear message to supporters that violence of any kind would be unacceptable.”

Mr. Feltman, who oversees UN support to elections globally in his capacity as Focal Point for UN Electoral Assistance, commended the electoral authorities for their preparations and underscored the readiness of the UN to continue providing financial and technical assistance to the electoral process.

In the category of “open government initiatives,” and “what’s good for the goose is good for the gander,” the Project on Government Oversight (US) is asking citizens to push the White House to finally fill the vacancy for the the Inspector General for the State Department:

Inspectors general are independent watchdogs within federal agencies that are essential to a well-functioning government. They conduct audits and investigations that identify wasteful government practices, fraud by individuals and government contractors, and other sorts of government misconduct. Congress and the public rely on their reports to hold agencies and individuals accountable for wrongdoing, identify a need for legislation, and evaluate the effectiveness of government programs and policies.

Unfortunately, President Obama went his entire first term without nominating an inspector general for the State Department. At over five years, the State Department opening is the longest running vacancy among federal agencies.

 

Wycliffe Muga in The Star on “Why we should not dismiss foreigners”, with an example from his own experience in Kenya, but perhaps a universal lesson.

In the category of “it could be worse”: “Is a military coup Museveni’s last line of defense against NRM rebels?” asks Gaaki Kigambo in The East African.

 

Worth reading on Kenyan pre-election violence, and challenge ahead for March election

“John Githongo: Former Anti-Corruption Czar on a mission to change Kenyan leadership” from November 2012 Think Business at “Kenyan Magazines”:

Based on Inuka Kenya’s mapping using information provided by credible Kenyan organisations and partners, more than 480 people have been killed since January 2012 in this violence. “It is pre-election violence associated with the new boundaries and the struggle for power. It is so insidious that it is almost passing unnoticed,” says John.

The new constitution, he adds, poses a lot of challenges for the transition process in terms of implementation. We have created new boundaries, instituted a system of devolved government and initiated new laws. Even the more developed economies have not attempted to implement the number of changes we are attempting to implement at the moment at one go. “We are a very versatile people but we will be tested in a way that is unprecedented.” He worries that the danger of things falling apart is that the disillusionment that might follow will cause Kenya to implode, not to explode, “Like an ice cream melting in the sun.”

Wycliffe Muga: Tobiko Is Not Fit To Hold DPP Position

I was surprised to learn, quite recently, that Uganda has a Ministry of Ethics and Integrity. It reminded me of a Tanzania-based expatriate I once met who assured me that her work was in advising a Tanzanian Ministry with an equally improbable name: the ‘Ministry of Beekeeping’ (I have since learned, incidentally, that this may have been a private joke of hers, as what Tanzania actually has is a Ministry of Natural Resources and Tourism, within which there is a ‘Forestry and Beekeeping Division’.)

All the same, I have to wonder what that Ugandan ministry, concerned as it is with ‘ethics and integrity’ would have made of the appointment of Keriako Tobiko as the Director of Public Prosecutions – something which seems imminent at the time of writing.

The question is, After all that we have heard, can we really believe that this is a man of sound ethics and undoubted integrity? Were the accusations made by Prof Yash Pal Ghai, merely a figment of the good professor’s imagination, or is it actually true that Tobiko considered the entire constitution-making process as little more than a ladder that he could use to get access to the top political circles, and thus ascend to high office?

At other times, these accusations may not have mattered all that much. In the first place, Kenyans were previously accustomed to a childlike obedience to the dictates of the imperial presidency. In the second place, doing the dirty work for those higher up than you – or even just having the unmistakable capacity for doing so – was a recognized path to advancement in both the Moi era, and the early years of the Kibaki presidency. But times have changed, and there is – I think – a critical mass of Kenyans who are determined that we should no longer live in a country where those in power more or less do as they please, and the rest of us just have to put up with it.

In the circumstances, accepting the appointment as DPP will most likely prove to be not so much a victor’s laurel on Tobiko’s head, as a crown of thorns. As long as he holds this office, every step he takes will judged against his seemingly irregular appointment, and unflattering assumptions will be made as to his motives for every serious decision he takes.

And there is no question that this is an irregular appointment. Nobody can say at this point whether he is guilty or innocent of all or any of these accusations. But it is clear enough that they bear looking into.

The Star launches on the web

Just in time for the election in Uganda, the Star in Nairobi has launched its website. The Star began as a competing daily to the Nation and Standard and to the other tabloids during my time in Nairobi. It quickly became a necessary political news read. Its launch on the web is a big step forward for Nairobi and Kenya as a regional media and communications hub, and a step forward toward a future of more accountability and better governance through greater openness. And a better media through competition.

The more outlets, the harder it will be for the Government of Kenya to suppress the news.

Nick Wadhams in Time has a good overview.

In the Star courtesy of the Mars Group media pages Wycliffe Muga suggests that William Ruto’s role as a “no” leader reflects his strategic plan to establish himself as political boss of the Upper Rift Valley rather than a serious expectation of actually defeating the proposed constitution.

In this month’s free article, Africa Confidential says “Campaigning for next month’s constitutional referendum is a mixture of ideology, religion and personal ambition – and now the thugs have moved in”.

Mugambi Kiai writes in the Star (via Mars Group): “It is so easy to miss the obvious. There is so much shouting around narrow sectarian issues that the massive gains in the proposed constitution are hardly getting any airtime” and goes in to detail several of the governance reforms.
