Kiai has taken note of a transparently fake “NGO” that has been playing in this years’ campaign space to sell in advance whatever results are going to be announced.  As you would expect in Kenya this “group” does not even seriously try to be subtle enough to be plausible to sophisticated observers, but gets picked up in the Kenyan media in pari passu with bona five organizations without scrutiny (at least until Kiai’s column).

Let’s hope international reporters who “fly in” for Kenya’s election do their homework this time.

IEBC’S CREDIBILITY

Something smells really fishy here, verging on being “fake news” meant to influence us with false information.

We clearly have not seen the end of that and we should all try to verify whatever is presented in the media.

And we have been here before. In the lead-up to the 2013 elections, the IEBC was polling as one of the top two institutions that Kenyans had confidence in, together with the Supreme Court, at the time led by Chief Justice Willy Mutunga.

But with all the shenanigans around procurement, gadget malfunctions, “server crashes” and a return to the discredited manual system for voter identification, tallying and transmission of results, the IEBC quickly lost its credibility.

The “chicken-gate” scandals involving the then chairman of the IEBC and the CEO further damaged the IEBC, even if the politicised Ethics and Anti-Corruption Commission eventually “cleared” the chairman.

ELECTORAL MALPRACTICE

I am not holding my breath that this IEBC will deliver credible, free and fair elections with the way it is operating.

It blames the courts for its unpreparedness, but this is more than about competence.

Like 2013, there is an emerging sense of willfulness in the way it is making decisions, short-cutting steps that could mitigate some of the emerging worries.

Incredibly, many of the key staff members who were involved in the previous mangled elections are still in place!

I am baffled that despite the court ruling that declares results final in the polling stations, the IEBC has not yet announced plans to ensure that returning and presiding officers are not only recruited transparently, but are based outside their home areas, to reduce ballot stuffing, especially given that we will probably use the easy-to-manipulate manual identification.

Now more than ever, these officials on the ground will determine the veracity of the election.

RIGGING

Rigging of elections has three basic strands.

The first is ballot stuffing, which is done at the polling stations by all sides (which then effectively balances out); the second is the changes by returning officers of results from polling stations under the guise of tallying, verifying and confirming the votes; and the third and most significant, is the massaging of figures done at the National Tallying Centre in Nairobi.

Note that the Krieglar report refused to go into the rigging at the National Tallying Centre, claiming that the evidence of ballot stuffing from both sides was enough to conclude that the 2007 election was irretrievably flawed.

Privately, Judge Krieglar was afraid that investigating the tallying at the KICC would present a different result from that announced and he did not want to be held responsible for more tensions when different results emerged.

OFFICIALS WITH INTEGRITY

Second, the argument that the National Tallying Centre should be retained to “correct” anomalies from the ground is facile and disingenuous.

It falsely assumes that the commissioners and senior staff are the only ones competent and with integrity, and should be trusted with “rectifying” obvious mistakes like more votes than voters registered.

It is the responsibility of the IEBC to recruit competent persons of integrity at all levels, rather than hire people whose work would need “rectification”.

Every time there is “rectification”, we simply get more rigging.

It is not harder to count the votes in Kenya than in other countries . . . it is just that so much goes in to obscuring those counts, done only at each polling station, so that freedom of action remains at “the center” in Nairobi.

“On Security, Corruption and Terror Attacks” from the Mzalendo blog:

The link between corruption and the country’s susceptibility to is also recognised in the Parliamentary Report on the Inquiry into the Westgate and other attacks in Mandera in North Eastern and Kilifi in the Coastal Region. The report mentions systemic corruption and the link to terror attack stating:

“Corruption has greatly led to the vulnerability of the country in many cases including where immigration officials are compromised thus permitting ‘aliens’ who could be terrorists to enter the country and acquire identification. This enables terrorists ease of movement and are therefore able to plan and execute attacks without the fear of discovery. Further compromising of security officials enables ‘suspected individuals’ to fail to pursue suspected terrorists and enable them to secure early release when caught or reported in suspicious criminal activities.”

Of the link between Kenyan troops in Somalia and the increase in terror attacks in the country the report states, “It should also be interrogated why other countries such as Ethiopia and Burundi who had earlier sent troops to Somalia have not been attacked by the al-shaabab. Tanzania has also not suffered any terrorist attacks after the 1998 bombings. Is it because our security forces are weak, in-disciplined and easily corruptible?”

The report makes further note of nationwide systemic failure on the part of the Immigration Services Department, Department of Refugee Affairs; and Registration of Persons Department, also “rampant corruption by security officers and other government agents,” and  further that, “police officers are corrupt and lax too. They work in cahoots with alShabaab and are paid to pass information to the latter.”

Last week National Assembly rejected the Joint Committees report and the recommendations made therein. However questions and issues in the report raised with regards to the link between corruption and terrorism still remain.

In commemoration of this historic election, the Africa Centre for Open Governance (AfriCOG) presents its own findings related to election day and its aftermath in this report. In line with its commitment to promote permanent vigilance by citizens over public life and public institutions, AfriCOG provides an account of voters’experiences at the polling station. In addition, the report details the counting, tallying and results transmission procedures, noting the varied problems associated with these procedures. Overall, in contrast to many observer reports, AfriCOG finds that the failure of electoral technology made it impossible to verify the manual counts of election results. This was compounded by a wide array of problems at the polling station, ranging from names missing from the voters’ register to voter bribery.

To conclude, AfriCOG recommends a series of reforms to ensure that future elections live up to constitutional standards for transparency and verifiability.

“After the Dust Has Settled” shiny new Kenyan institutions left dingy

Dr. Stephanie Burchard has a piece in the current issue of the Institute for Defense Analyses’ Africa Watch entitled “After The Dust Has Settled: Kenya’s 2013 Elections”, noting the unexplained failure of the IEBC to release election results that were required in mid-March until mid-July.  The key takeaway:

Unfortunately, after all that has happened since, it is unclear how much respect or trust Kenyans continue to have in their political institutions.  Politicians seem wary of Kenya’s political institutions.  Raila Odinga promised that he and CORD would boycott future elections until changes within the IEBC take place.  Even more troubling, public trust in Kenya’s new institutions appears to be eroding.  In early July a national survey conducted by Ipsos Synovate revealed that confidence in Kenya’s new political institutions, including the Supreme Court and the electoral commission, had fallen precipitously over the course of the past few months.  In particular, confidence in the IEBC had fallen by 30 percentage points–from a high of 62 percent in February to 32 percent less than five months later.

134 days after election, Kenya’s IEBC fails to produce election results in Parliament

Daily Nation, July 16, “IEBC fails to submit final poll tally” :

The electoral commission failed to furnish Parliament with the final results of the March 4 General Election Tuesday amid claims that some commissioners refused to sign the report.

 

The commission was expected to submit the final tally to the Justice and Legal Affairs committee at a meeting scheduled with the team at Parliament Buildings Tuesday. The committee was to relay the report to Parliament.

 

Independent Electoral and Boundaries Commission chairman Issack Hassan and chief executive James Oswago appeared before the committee but were turned away after the chairman indicated that the tally was not ready for submission as per the request from Parliament. . . .

Kenya’s IEBC dangles “kitu kidogo” for political parties to avoid publishing election results

The Star reported this week that the “IEBC wants political parties act amended“. From the headline one would expect to read perhaps an article on some type of reform arising out of the failed primary elections early this year, or the problem with “party hopping” . . .

But of course, it would be silly to think that the IEBC would concern itself with such things to improve accountability in the Kenyan electoral system.

No, the IEBC is faced with a problem. It doesn’t want to publish the election results. For the reason noted in my last post: the numbers of votes for the other offices don’t add up to the numbers of votes for president–according to the anonymous Commissioner quoted in the story, adding a direct confession to the clear circumstantial evidence that we have all seen for many weeks now.

The IEBC is attracting no visible pressure from Washington or London or the other “donors” who helped underwrite the IEBC. Whether this is because, as in 2007-08, the foreign policy mavens think it’s “better not to know” or whether because, as always, the foreign assistance mavens want a “success story” as much as a better democracy in Kenya in the future–or both–I don’t know.

So the immediate rub is the delay in providing public funding to Kenya’s political parties based on the election results. How to relieve pressure from pols who want the tax dollars doled out without publishing the election results that determine how the money is allocated? Change the law of course! So the money can be paid out without disclosing the results! An elegantly Kenyan solution.
