New Development in Reading the Pre-Election Kibaki Tea Leaves: GOK repays DfID for “education scandal”

I don’t want to make everything that happens in Kenyan government and politics in early 2013 “about” the Kibaki succession, because, of course, there are the “down ticket” races that matter, too.  Nonetheless, I was fascinated to see the news in the Standard this afternoon that the Kenyan government had repaid the British official aid agency DFID for losses on the “education scandal” that was current news at the time I started this blog just more than three years ago: “Kenya repays stolen fee education cash”.

The “education scandal” and the “maize scandal” were the two big breaking new corruption eruptions under the Government of National Unity that served to remind everyone that simply adding part of ODM to the second Kibaki Adminstration in April 2008 did not in itself solve anything regarding corruption.  The “maize scandal” was a new and insidious plot for the corpulent corrupt to “eat” off of hunger in the food crisis in 2009; the “education scandal” was the revelation of an older and ongoing insidious plot for the elite to steal from school children, dating to the inception of “free primary education” early in the first Kibaki Adminstration.

Why repay the money now?  One suggestion might be that this is an indication that Kibaki does have concern about his post-presidential reputation, his “legacy”.  Perhaps there is something to this.

Of course, Kibaki is a master of not communicating his intentions, conducting affairs behind closed doors and letting Western (and Kenyan) observers who feel compelled to do so offer speculative analysis and opinion to substitute for actual knowledge about what he is up to.  So who knows?

Amazingly, to me anyway, I have read otherwise trenchant reports and analysis of various aspects of the Kenyan situation that include unembellished lines to the effect that Kibaki will not be a major factor in the upcoming election as he is concluding his second and final term.  To me, it is quite obvious that H.E. Mwai Kibaki will remain the most important individual in the 2013 Kenyan presidential election until he passes the mace to his successor.  With the new constitution, partially implemented, he has less direct and formal power in the 2013 election than he had in the 2007 election.  He remains, nonetheless, far more powerful than any other single individual, even Uhuru Kenyatta or Raila Odinga certainly, and more by far than any one member of his inner circle.  How he will use that power, and how much we will even ever know about how he uses that power, are in question.

Would it be hard for Kibaki to hand off the presidency to Raila Odinga this time?  The polls show Odinga leading but Uhuru in range with just a few weeks to go, so in some ways the race is similar to 2007.  Not to suggest that Kibaki would prefer Uhuru in the way that he preferred himself in 2007, just taking note of the parallels.  Some people have suggested that he might prefer Saitoti or later Mudavadi to either Raila or Uhuru, but did they really know something or were they going on guesses, rumours or even misinformation? Certainly the dynamic of having a possible runoff and the need to win in the counties makes things different and more complicated this time.  It will be interesting to watch.

In the meantime, congratulations to DfID and I will hope that President Kibaki does in fact want to leave office with the best possible reputation on governance and corruption issues in these closing weeks.  UPDATE: (I do think that it must be noted that there is no indication here of an intent to actually recover “stolen” funds, rather that the Kenyan taxpayers are taking up the burden from the British taxpayers.)

Here is news from Saturday, Jan. 12 that President Kibaki has refused to assent to the hugely controversial Retirement Benefits bill passed by the 10th Parliament on their way out of office, awarding themselves a big gratuity of 9.6M KSh on leaving office, along with post-parliamentary benefits such as state burial and security, diplomatic passports and airport VIP lounge access.

Freedom of Information Series (Part Eleven): Better to Learn More Lessons from Kenya’s Last Election After the Next One?

Back last May I had checked in with the State Department’s Freedom of Information Office about the status of outstanding documents from my 2009 FOIA requests regarding the 2007 Kenya elections.

At that time the FOIA Office wrote me that State Department documents about the IRI and USAID Exit Poll had finally been received from the Africa Bureau, presumably including the U.S. Embassy in Kenya, in addition to just the Central Records in Washington. (From what I had been told by the FOIA Office previously, the Africa Bureau did not respond for well more than two years following my original FOIA submission.) The estimated additional time to review and release documents was six months, to November 30, 2012.

November 30 came and went with no documents. i wrote to request release on an expedited basis due to the new elections upcoming but got no response. Checking back I was eventually given a new date of May 2013, after the new Kenyan elections.

A lot of people in a variety of capacities in the U.S. government, or otherwise funded by U.S. taxpayers, are working on matters involving the March Kenya elections. Likewise, from other donor governments and international organizations. And of course Kenyans who bore the actual effects of the disaster in the last elections have the most at stake in the new elections. Why further delay disclosing and addressing the documentary record from 2007?

Impunity for election fraud in 2007 makes the 2013 Kenya elections riskier. Even though there will be no accountability now, Americans and Kenyans should at least know as much as possible about what happened.

Reflecting on the state of the Kenyan presidential race in its closing weeks, I had come to the conclusion that there was very little I should say, because it seemed that there was just too much “backstory” and intrigue behind the scenes that was not in the media and I was not privy to.  It becomes misleading to pretend that what is apparent on the surface counts for more than it really does.  Certainly a crucial lesson from the 2007 election.

Today, as voter registration is wrapping up, Musalia Mudavdi has revealed and Uhuru Kenyatta has admitted that the two signed in the presence of their lawyers an agreement two weeks ago, on the “coalition” deadline, for Kenyatta to step aside in favor of Mudavadi for the TNA/URP/UDF–“Jubilee Alliance” nomination.  Facing a revolt within his TNA party, Uhuru now wants out of the deal on the basis that he signed under the pressure of powerful forces who claimed that such a move would be in the national interest of Kenya.

The Standard: “Uhuru rescinds decision to back Mudavadi”

Uhuru rescinded his support for Mudavadi as Jubilee presidential candidate and said the decision on who will carry the alliance mantle rests with delegates.
He confirmed authoring the document and signed it but claimed that he was coerced by ‘the devil’.
He said on Tuesday that powerful forces convinced him that his presidential bid was bad for the nation as Kenya would face international sanctions if he wins the elections and that Kenyans were not ready for another president from Mt Kenya.
He confirmed that MPs forced him to rescind his decision and said only delegates will sign.

In the meantime, the IEBC voter registration effort is wrapping up.  It appears that the final totals will be well short of the announced goal of 18 million voters, but in excess of the new fallback target the IEBC announced of 12 million (or 1/3 less).  The 2007 figure was 14,294,739 per the IRI/UCSD/USAID Exit Poll.

It has been a week since my last post, even though so much is happening on a day to day basis with the Kenyan election and lots of other news in the region–this reflects a few different things.  For one, perhaps what we could call a “Christmas armistice”.  I live in a peaceful place, and I am enjoying the “festive season” here with my family and am committed to a less digital Christmas.  We’ve survived another election here in the States (in spite of ourselves) and there are a several weeks left in the campaign in Kenya and this is a good time to step back a bit.  In particular, for my family, this is the last Christmas before my daughter goes off to college.  I took my son, our youngest, to get his driver’s license yesterday.  These are the things that can’t wait (and that are uniquely my responsibility).

For another, I have been at this blog steadily for three years.  It’s been through various evolutions and trends and this is an appropriate time for reflective recalibration about what I want it to be going forward.  And in the meantime, there are 601 posts out there for those interested.  And too many of those are just “news” and not real writing, and I do know that I want to get back to “better” rather than “more”.

A third is that I have both new freedom, and new constraints that I need to adjust to.  When I started this blog, and for the first two-and-a-half years, I was a lawyer in the defense industry.  For this reason, I always needed to keep a strong separation between my blog and my professional life.  When I attended the African Studies Association or participated in a “bloggers’ roundtable” at the Millennium Challenge Corporation I was on vacation from my job and generally didn’t talk about it much (both awkward and expensive).  When I was living in Kenya and working for the International Republican Institute I kept entirely away from the job from which I was on leave back home.  Now that I am an independent lawyer, I can synthesize what I know from my prior legal experience and otherwise what I do for a living with the blog to whatever extent I chose, so this is easier.  At the same time, I am also now available professionally as a consultant in matters involving East Africa and have accepted some work, so I need to avoid any conflicts arising out the transition from being purely an avocational commentator.

One thing I have reflected on this past week is the issue of how much is similar and how much is dissimilar between the 2007 campaign in Kenya and the 20012/13 campaign.  All of the major players are the same, although Kibaki will be transitioning from President to “retired President” as Moi is called, and is thus not a candidate himself.  I did get somewhat acquainted at that time and in that environment with Raila and Kalonzo and Mudavadi, and did meet Ruto although never sat down with him.  Uhuru and Dr. Willy Mutunga, who was then at the Ford Foundation and is now Chief Justice, were the only people that ever turned down a meeting request on my behalf when I was IRI Director (a nice symmetry in terms of KANU/Establishment versus Civil Society/Activist roles) so I do have some real sense of many of those involved.  On the other hand, a lot has changed in Kenya, for better and worse, since 2007/08.  So although I know much, much more about Kenya from what I have done from here since I moved back, I don’t want to fall into the trap of relying too much on past experience.

One thing this adds up to is that I do want to write more about “democracy promotion” or “assistance” as a subspecies of “foreign aid” in Africa beyond just the current and most recent past campaign in Kenya.  I also want to do more with East Africa as a region in interacting with the United States–I drafted a “year in review” summary regarding IGAD for a bar committee I am participating in which reminded me of interesting things to explore about how domestic politics in Kenya and in the U.S. will influence cooperation and integration among the East African and HOA states. And then there is Somaliland, which is near and dear to my heart, but I am very cautious in writing about.

When did Ruto and Uhuru fight? And why is the “Uhuruto” alliance allegedly so surprising?

Today is the third anniversary of the “AfriCommons Blog”, so let me celebrate by being a bit direct.

I lived in Nairobi with my family during the last Kenya elections campaign and the duration of the post-election violence. I certainly saw both Uhuru and Ruto in Nairobi during the uncertain post election period, and they were on local television as well–serving in Parliament together and carrying out their functions as members of the political class. Never saw either with a police rifle, a panga or a can of petrol. No recollection of seeing either of them in the slums or other types of neighborhoods where most of the violence in Nairobi took place.

Rather, the ICC has accused them of being involved in the incitement, organization and funding side of the organized part of the post election violence or PEV.

I don’t recall ever seeing any indication that the two had any type of personal animosity between them or couldn’t get along between themselves. Could be, but not necessarily obvious from the context of funding militias and gangs in the hinterlands on opposite sides of a political tussle. In terms of the political debate it was Martha Karua that squared off with Ruto during the ECK “vote counting” at the KICC and the post-election negotiations.

When I moved to Kenya in June 2007, less than seven months before the elections, Uhuru and Ruto, along with Mudavadi, Raila and Kalonzo were in ODM-K (later to become ODM) and all were running against each other for the opposition presidential nomination through their mutual coalition. Uhuru was KANU leader and titular Leader of the Opposition in Parliament. They were all rivals, but all against Kibaki. Uhuru and Kalonzo split off the main ODM, with Kalonzo running as ODM-K nominee as a “third party” and Uhuru switching sides to Kibaki/PNU, presumably at least in part because he could not hope to get re-elected to his seat in Parliament in Central Province otherwise. (And maybe he was looking to 2012/13.)

If there was a question of anyone not getting along personally, it was more about Kalonzo and Raila than Uhuru and Ruto.

It just seems naive to me to be especially surprised that Uhuru and Ruto would hook back up–and most especially so when they are in a serious jam together with the ICC charges.

Did Uhuru oppose Moi because of Moi’s role in the related violence in the Rift Valley around the 1992 and 1997 elections? Seems to me he stayed in KANU and was anointed as Moi’s candidate for the succession in 2002. Perhaps if he did, as accused, get involved in using the Mungiki in post-election violence in Naivasha and elsewhere, could it have been for instrumental political reasons rather than some atavistic “tribalism”? Has Ruto ever supported a non-Kalenjin candidate before? (hint: Uhuru in 2002)

Today was the deadline for filing of pre-election agreements between and among Kenya’s political parties. No big surprises in terms of the basic shape of the Odinga-led versus the Kenyatta-led groupings. As this is a non-partisan blog, and I don’t vote in Kenya as an American, I will not be suggesting how Kenyans should vote or endorsing anyone, but I’ll share a few quick thoughts “from where I sit”.

The agreement of Vice President Kalonzo Musyoka to be Raila’s running mate seems to have come down to the wire, although it is a bit hard for me to see how this would be too much of a surprise to people paying close attention.

Ostensible ODM Deputy Prime Minister Musalia Mudavadi, Raila’s running mate last time, joined Uhuru Kenyatta’s TNA grouping at the last minute, but he has been out of ODM and on to UDF for a long time and has long been seen as the potential “compromise” candidate to substitute for Uhuru and/or Ruto in the event the Kenyan courts were to ultimately disqualify either or both of them due to the ICC cases or some related complication. It would be risky for Uhuru and Ruto not to have someone suitable in that role.

On the Odinga side, the new CORD grouping has picked up Charity Ngilu and NARC along with Kalonzo which means he has picked up both sides of a division within “Eastern” politics and added a woman of longstanding political stature. With both Kalonzo and Moses Wetangula, CORD has two former Foreign Ministers, with Kalonzo in particular having been around a long time in diplomatic circles. He is someone with whom those in foreign capitals who are concerned with Kenya’s stability as a perceived regional anchor will be used to and comfortable with.

Absent the ICC situation, Uhuru and Ruto would be potentially attractive to some in the West as representing the notion of a mini “grand coalition” appeasing the elite of the combatants in the violence related to land and political boundaries in the Rift Valley that has normally coincided with Kenyan elections post-Cold War and they will be well funded to try to sell that pitch irrespective of the pending charges. I have a hard time seeing them get any traction, but I have been wrong before.

No disrespect intended to the other candidates–another post for later. The whole thing will be fascinating to watch, but scary due to the real dangers.

Voter Registration challenges on Kenyan Coast

Nation: Voting problems on Coast. One is potential intimidation tactics discouraging voter registration, with the IEBC finding flyers calling for voters not to register or vote, and reports that youth, possibly associated with the separatist group the Mombasa Republican Council, have been seen copying down names of those registering. The second problem is that some politicians and local officials are reporting that groups of voters are being ferried from their home areas to register in other locations.

Obviously the IEBC will have large challenges. No surprise in that. A big question will be whether the IEBC will be seen as taking some level of decisive action to get in front of these situations, or not. In 2007 election, I was told afterwards that once it became clear that the ECK was both toothless, and not going to be an honest broker, the process degenerated as most of the players expected rigging and acted accordingly.

(Updated) Kenyan diaspora disenfranchised?; Kwamchetsi Makokha raises concern about Kenyan voter education; IFES seeks consultant

Update (Nov. 28):  IEBC Chair Isaac Hassan says that as an independent commission the IEBC will make its own decision about whether to cancel diaspora voting and is not bound by the Cabinet decision announced below.  He acknowledged that registration is not underway and that this part of the vote is in jeopardy.

Kenyans in the diaspora will not vote in the March 4 General Election, the Cabinet decided last Thursday.

Justice and Constitutional Affairs minister Eugene Wamalwa said the government decided that it will be impossible for Kenyans living abroad to vote owing to challenges facing the Independent Electoral and Boundaries Commission.

Mr Wamalwa said time and logistical constraints will not allow IEBC to register Kenyans in the diaspora. . . .

It’s been almost 2 1/2 years since the new constitution finally passed, providing for a right to vote for Kenyans living in the diaspora.  I am no big fan of the concept myself, but this is the law and I don’t see any unexpected challenges or difficulties in implementing it.

“Step up voter education, IEBC told” Daily Nation:

National Democracy Institute (NDI) consultant Kwamchetsi Makokha said on Tuesday the three months set for civic education was not enough to reach eligible voters.

“The period is not enough to reach the whole population. So many people know nothing about the devolved government and roles of the leaders,” he said. . . . during the launch of a sub-committee of the Political Parties Liaison Committee in Lamu.

I’ve heard elsewhere that there is significant lack of awareness by voters as to the nature of new positions up for election under devolved government under the new constitution.

In the meantime, IFES, the International Foundation for Electoral Systems, is advertising for an Election Administration Advisor for Kenya:

In preparation for the 2013 elections, IFES is implementing a capacity-building program in support of Kenya’s electoral process in the areas of election technical support, voter registration, voter education, and election dispute resolution among others.

Under this short-term assignment, IFES seeks to support the integration of activities of other government and non-government organizations, who play critical roles in the electoral process, including but not limited to the Registrar of Political Parties, Political Parties and Candidates, Security Agencies, the Judiciary, Civil Society Organization, Religious Organization, and the Media.

“And the beat(ings) go on . . .”; as 2007 bleeds into 2013, what would it take for Human Rights Watch and others to make Kenyan politics less deadly?

The latest Kenya release from Human Rights Watch, dated yesterday, decries the terrible beating of Kenyan activist Okiya Omtatah Okoiti.

Omtatah, executive director of Kenyans for Justice and Development (KEJUDE) Trust, a local NGO that advocates for transparency and accountability, was attacked by two unidentified men in central Nairobi. He lost six teeth and suffered serious injuries to his face and the back of his head, which required surgery. Omtatah told Human Rights Watch and ARTICLE 19 that the attackers demanded that he withdraw a lawsuit he filed to demand accountability in the procurement of biometric voter registration (BVR) kits because of corruption associated with the process.

“This vicious attack was clearly meant not just to intimidate Omtatah but to seriously injure him – and perhaps even to kill him,” said Leslie Lefkow, deputy Africa director at Human Rights Watch. “The aim seems to be to stop his work on corruption in the procurement of biometric voter registration kits for the upcoming elections.”

Certainly this is a crucial and timely issue in working toward integrity in the upcoming Kenyan election and in protecting an activist who took a big risk in pursuing legal action against election-related corruption. So kudos to Human Rights Watch and Article 19 for calling attention to the attack. Unfortunately, it is hard to imagine that anything will actually happen as a result of this statement that “[t]he Kenyan authorities should promptly and thoroughly investigate a serious physical assault . . . and bring appropriate charges.” Of course, they should–that goes without saying; of course. they won’t.

Why won’t they? Are they confident they can wait it out and the outside actors and international players who care about Omtatah now will move on to the next outrage, the next victim, without really disrupting the vicious cycle?

Why would I suggest this? Not to be gratuitously critical of Human Rights Watch or any of the many organizations trying to support human rights defenders. Rather I say this on the basis of my own hard-earned experience with well-intentioned failure in dealing with election fraud and violence in Kenya in 2007/08. I moved my family to Kenya for a year to help support democracy in the last election cycle–we were able to take in a couple of displaced families for a few months after the election, and help a few others a bit, but nothing that I did in my NGO work really changed anything as far as upholding democracy. My organization, IRI, issued a report noting the election fraud, in July 2008, and in August 2008 released the exit poll showing that voters at the polls on election day reported favoring the opposition, before the mark-ups of the tallies for the incumbent at the Electoral Commission in Nairobi afterwards. But these reports were months too late to really matter. It is going to take more to make a difference in the brutal world of Kenyan politics.

Kenyan voter registration underway; new poll and new security incidents

Kenya’s biometric voter registration finally got underway yesterday, with relatively low turnout.  The main reported glitch appeared to be problems with BVR kits losing power after using up their battery life.  The registration period runs through December 18.  Because of the delays with the BVR kit purchase, the deadline of December 4 for formation of party coalitions, three months before election day, falls during the middle of the registration period.

A substantive enfranchisement problem is that only those possessing and producing an official national identity card or Kenyan passport are permitted to register.  Those waiting for identity cards will be out of luck so a burden will rest on the Registrar of Persons to expedite issuance of identify cards.  See the official announcement from the IEBC here.

An op/ed piece in The Nation from Prof. Kefa Otiso of Bowling Green University, the president of the Kenya Scholars and Studies Association, raises disenfranchisement concerns about the current version of the IEBC’s plans for diaspora registration and voting in the U.S., which would require in person registration and subsequent voting in Washington, New York or Los Angeles.

The new Synovate poll shows Odinga continuing as the front-runner, followed by Uhuru in a solid second position, but both have slipped slightly since their last poll in September.  Here is the report from The Star on the Ipsos Synovate press conference:

Prime Minister Raila Odinga who is the poll’s leading candidate has 33 per cent, followed closely by Uhuru Kenyatta with 26 per cent.

Both candidates have dropped in popularity since the last Synovate polls conducted in September. Raila has lost three percent while Kenyatta has lost four per cent of the votes.

Candidates and areas that have gained in the polls are Eldoret North MP and presidential hopeful William Ruto and Deputy Prime Minister Musalia Mudavadi.

They have both of gained three per cent popularity poll. Additionally the number of undecided voters has increased to 11 per cent up from nine per cent in September.

Dr. Tom Wolf, a socio-political analyst with Ipsos Synovate attributed this shortfall of votes by the candidates to the unfinalised political alliances.

In the meantime, Nairobi remains tense after the latest Sunday matatu bombing, this time killing several people in Eastleigh, followed by rioting with Somalis targeted.  Garissa is under curfew following the shooting of three Kenya Defense Forces soldiers, which then led to what the BBC is calling an army “crackdown” with at least 8 Kenyans shot and 50 wounded.  The Kenyan Defense Minister told BBC that he did not authorize the action, which naturally raises its own set of questions.
